ORDINANCE #1-1995

AN ORDINANCE TO REGULATE BOATING, WATER TRAFFIC, AND WATER SPORTS
UPON THE INLAND WATERS OF THE TOWN OF SAMPSON AND PRESCRIBING PENALTIES FOR VIOLATION THEREOF.

The Town Board of the Town of Sampson do ordain as follows:

SECTION I. AN ORDINANCE establishing use restrictions on Round Lake in Town of Sampson.

SECTION II. TITLE OF ORDINANCE: This Ordinance shall be known, cited and referred to as the "No Wake Zone Ordinance" (hereinafter referred to as "Ordinance").

SECTION III. PURPOSE, AUTHORITY AND APPLICATION:

(a) The purpose of this Ordinance is to institute use regulations and restrictions on Round Lake to protect and preserve major plant beds, resources and water quality of Round Lake for the enjoyment of aquatic recreation consistent with public right's and interests and the capability of water resources.

(b) These regulations are established, in the interest of public health, welfare and safety, pursuant to the statutory authorization for Lake District ordinances 30.81 (1) (1M) Wisconsin Statutes.

(c) The regulations specified in this Ordinance shall apply within the Town's limits.

(d) The provisions of this ordinance shall be enforced by the officers of the Safety Patrol with the Chippewa Co. Sheriff's Department.

SECTION IV. NO WAKE ZONE

(a) The Round Lake Protection & Rehabilitation Commissioners and their designee, Chippewa Co. Parks and Recreation Committee shall cooperate in placing buoys to delineate the "No Wake Zone" on Round Lake.

(b) Definition: "Slow-no-Wake" means that speed at which a boat moves as slowly as possible while still maintaining steerage control.

(c) The "No-Wake Zone" on Round Lake shall consist of that area more specifically defined on the map attached hereto as "Exhibit "A" and incorporated herein as fully set forth.

(d) Violations: No person shall operate a boat faster than slow-no-wake within the area designated as slow-no-wake in this ordinance and marked accordingly with regulatory buoys.

(e) Penalties:  Any person, partnership, corporation, or other legal entity that fails to comply with the provisions of this ordinance shall, upon conviction, be penalized by the Town of Sampson Penalties Ordinance 1-2007.

SECTION V. All ordinances in conflict with the foregoing are hereby repealed or amended to read consistent with this Ordinance.

SECTION VI. This Ordinance shall take effect upon passage and publication.
