TOWN OF SAMPSON PENALTIES ORDINANCE

Section 1. Title and Purpose.

The title of this Ordinance is the Town of Sampson Penalties Ordinance. The purpose of this ordinance is to specify the penalties and the amount of forfeitures authorized by the Town Board of the Town of Sampson for citations for violations of Town of Sampson ordinances, including ordinances with statutory counterparts.

Section 2. Authority.

The Town Board of the Town of Sampson has the specific authority under sec. 66.0113, Wis. Stats., to adopt this ordinance.

Section 3.  Adoption of Ordinance.

The Town Board of the Town of Sampson, by this ordinance, adopted on proper notice with a quorum and by a roll call vote by a majority of the Town Board present and voting, provides the authority for the Town of Sampson to issue citations for violations of Town of Sampson ordinances, including ordinances with statutory counterparts.

Section 4.  Penalties.

Unless otherwise specified or stated in an Ordinance, any person who shall violate any provision of a Town of Sampson ordinance shall be subject to a penalty as follows:

A.  First offense penalty.  Any person who shall violate any provision of a Town of Sampson Ordinance subject to a penalty, shall, upon conviction thereof, forfeit one hundred dollars ($100.00), together with the costs of prosecution.

B. Second offense penalty.  Any person who shall violate any provision of a Town of Sampson Ordinance subject to a penalty, who shall previously been convicted of a violation of the same ordinance within one year, shall, upon conviction thereof, forfeit two hundred dollars ($200.00), together with the costs of prosecution.

C. Continuing violation.  Each violation and each day a violation continues or occurs shall constitute a separate offense.  Nothing in this ordinance shall preclude the Town of Sampson from maintaining any appropriate action to prevent or remove a violation of any provisions of Town of Sampson ordinances.

Section 5.  Severability.

If any provision of this ordinance of its application to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of this ordinance that can be given effect without the invalid provision of application, and to this end, the provisions of this ordinance are severable.

Section 6.  Effective date.

This Ordinance is effective on publication or posting.

The town clerk shall properly post or publish this ordinance as required under s. 60.80, Wis. stats.
