The Town Board of the Town of
Preamble: In furtherance of public good and toward the
economical and orderly development of the Township, the Town Board of the Town
of
Section 1. Road Definition:
This
ordinance shall apply to all new roads, highways, avenues and streets of the
Town of
Section 2. Specifications-Minimum standards of road construction:
B. Surveyed, staked & dedicated roadbed 26 feet
C. Roadway Width (base course) 26 feet
D. Traffic Lanes (surfaced) 20 feet
E. Maximum Grade 11(%) percent
The

F. No road shall dead-end without a permanent or temporary cul-de-sac with at least a 125 foot radius
G. Ditches:
1. All ditches shall be seeded, sodden or provided with sodden check dams at the discretion of the Town Board.
2. All portions of the right-of-way beyond the edge of the base course that are disturbed at the time of construction shall be adequately seeded or sodden to the Town Board’s approval to prevent erosion.
H. There shall be sand to fill to within six (6) inches of grade. The grade shall be considered the top of the base course for construction purposes. There shall be no trees or stumps allowed in said fill.
I. Bridges and Culverts:
1. Culverts and culvert size shall be approved by the Town Board and be adequate to handle maximum vehicle load expected; size and diameter shall be adequate to drain the area without subsequent ponding during heavy runoff.
2. The Town Board may require drainage calculations for the culvert placement, the cost of which shall be born by the developer or owner.

shall be constructed according to designs, which bear the seal of a civil
engineer certified by the State of

2. Bituminous paving shall be applied no sooner that (1) year and no later that thirty-six (36) months after the application of the base courser.

Bituminous paving shall conform to W.S. H. C.
specification gradation #2 and shall be applied to a depth of two (2) inched
compacted. The Town of
4. Shouldering material shall be the same material as J (1) and shall be completed immediately after bituminous paving is completed. It shall be compacted and level with bituminous edge.
5. Alternate materials shall be approved by the Town Board and must meet D.A.T. standards.
K. All required signs and placement shall meet D.O.T. standards. The Town Board shall deem placement of signs necessary. The signs and placement will be at the expense of the developer or owner.
L. The Town Board will determine which safety devices are deemed necessary such as beams, guardrails etc at the expense of the developer or owner.
Section 3. Scale drawing:
Three (3) copies of a
scale drawing of the proposed road indicating location and showing relief of
the area with two (2) foot contour elevations shall be submitted to the Town
Board. Included in the drawing shall be
the area that will be served by the road and the manner in which drainage from
the area served is to be treated. If the
road is not included in subdivision, then a certified survey of said road shall
be provided and a deed, or deeds, of all road right-of-ways shall be tendered
showing transfer to Town of
Section 4. Performance Bond
The person, firm or corporation undertaking the road construction shall file with the Town Clerk a performance bond in a form approved by the Town Attorney, or, as an alternative to a performance bond, a certified check or letter of credit from a federal or state bank, savings and loan or credit union authorized to do business and in good standing in the State of Wisconsin. The performance bond, certified check or letter of credit shall be subject to the approval of the Town Board and shall be in an amount equal to the estimate of the cost of the said road construction determined by the Town Board. The performance bond, certified check or letter of credit shall constitute a guarantee that such improvements will be completed within a time period as set by the Town Board and in failure thereof, shall permit the Town Board to enforce the bond or, in the event of a certified check or letter of credit, to draw thereto such as, but no limited to, engineering and inspection costs.
Section 5. Inspection and
Acceptance
The Town Board, or its designated Road Superintendent, shall visually inspect any road before approval and acceptance, and, if the improvement passes inspection, the Town Clerk will issue a letter to that effect. The person, firm or corporation undertaking the road construction shall within ten (10) days thereof conveys the road right of way by deed to the Town. The Town Board shall not accept any road until the person, firm or corporation undertaking the road construction corrects all defects revealed in inspections made of the road. Said person, firm or corporation shall correct any defect within one year after the date of substantial completion of the road as determined by the Town Board. In the event that such correction is not completed within the one-year period the Town Board shall be authorized to exercise the performance bond or draw upon the certified check or letter of credit to correct such defects. Each performance bond, certified check or letter of credit shall be in effect throughout the one-year period in order to cover corrections of defects.
Section 6. Severability
Every provision of the Ordinance shall be considered separable, and the invalidity of any section, clause, provision or portion hereof shall not affect the validity of any portion.
Section 7. Effective date
This ordinance shall be effective upon
passage and publication as provided by law.
This Road Standards Ordinance supercedes any and all previous
highway/road Ordinances of the Town of
Adopted this 3rd day of November 2003.
