SLOW-NO-WAKE ORDINANCE FOR LOON LAKE

 

A SOLE ORDINANCE TO REGULATE BOATING UPON THE WATERS OF LOON LAKE, TOWN OF SAMPSON, CHIPPEWA COUNTY, WISCONSIN, AND PRESCRIBING PENALTIES FOR VIOLATION THEREOF.

 

The Town of Sampson Board of Chippewa County, Wisconsin, ordains as follows:

 

 

Section I.  Applicability and Enforcement.

 

(A) The Provisions of this Ordinance shall apply to the waters of Loon Lake, located in T32N, R9W, Sections 15 and 22, Sampson Township, Chippewa County, State of Wisconsin.

 

(b) This ordinance shall be enforced by the Chippewa County Sheriff's Office.

 

 

Section II. Intent and Authority.

 

(A) The intent of this ordinance is to provide safe and healthful conditions for the enjoyment of aquatic recreation consistent with public rights and interests, and the capability of water resources as stated in the attached Condition Report, hereby incorporated by reference.

 

(B) This ordinance is adopted pursuant to §30.77(3)(a), Wis. Stats., which authorizes any Town, Village or City, to, in the interests of public health, safety or welfare, adopt local regulations not contrary or inconsistent with Chapter 30, Wis. Stats., relative to the equipment, use or operation of boats or relative to any activity regulated by §30.60 to 30.71, Wis. Stats.

 

 

Section III.  State Boating and Safety Laws Adopted.

 

(A) State boating laws as found in §30.50 to 30.71, Wis. Stats., are adopted by reference.

 

 

 

 

 

Section IV.  Definitions.

 

(A)  "Slow-No-Wake" means that speed at which a boat moves as slowly as possible while still maintaining steerage control.

 

(B)  "Person" includes an individual, partnership, corporation, the state and its agencies and subdivisions, and any other legal entity.

 

(C) "Operate" means to navigate or otherwise use a watercraft.

 

(D) "Watercraft" means any contrivance used or designed for navigation on water.

 

 

Section V.  Controlled Area.

 

(A) No person shall operate a watercraft faster than slow-no-wake in the waters of Loon Lake at any time.

 

(B) Exceptions.  The following shall be exempt from the provisions of this ordinance:

 

(1) Authorized resources management personnel, emergency personnel, and enforcement personnel, when acting in the performance of their duties.

 

(2) Persons operating watercraft within an area defined as: Starting from the North edge of the Loon Lake, Town of Sampson boat landing, going East to the first buoy placed at GPS coordinate (a) Lat.45 degrees 14.98 minutes Long. 91 degrees 28.26 minutes; (b) Continuing South East to buoy at Lat. 45 degrees 14.85 minutes Long. 91 degrees 28.09 minutes; (c) Continuing South to buoy at Lat. 45 degrees 14.74 minutes Long 91 degrees 28.07 minutes and then continuing South West to the point of the peninsula located on the West shore of Loon Lake, and as specifically defined on the map attached hereto as "Exhibit A" and incorporated by reference herein as fully set forth.

 

 

Section VI.  Posting Requirements.

 

The Town of Sampson shall place and maintain a copy of this Ordinance at all public access points within the jurisdiction of the Town pursuant to the requirements of NR 5.15, Wis. Adm. Code.

 

 

Section VII.  Penalties.

 

Any person, partnership, corporation, or other legal entity that fails to comply with the provisions of this ordinance shall, upon conviction, be penalized by the Town of Sampson Penalties Ordinance 1-2007.

 

Section VII.  Severability.

 

The provisions of this ordinance shall be deemed severable and it is expressly declared that the Town of Sampson Board would have passed the other provisions irrespective of whether or not one or more provisions may be declared invalid.  If any provision of the ordinance or the application to any person or circumstances is held invalid, the remainder of the ordinance and the application of such provisions to other persons or circumstances shall not be affected.

 

 

Section IX.  Effective Date.

 

This section will become effective upon passage on the day after publication.  Section V.(B)(2) shall remain in effect for three years from the date of publication unless the effective time period is extended by the Town Board.
