An ordinance to regulate water
traffic boating and water sports upon the water of
The Town of
Section 1. Applicability and Enforcement.
(A)T he provisions of this Ordinance
shall apply to the waters of Two lsland
Lake, located in T 32N, R8W, Sections1
9,2 0,29a nd3 0, Sampson Township, Chippewa County, State of Wisconsin, as
shown on the map contained on page 60; of the Chippewa County 2OO2 Land Atlas
and Plat Book, hereby incorporated by reference.
(B)This ordinance shall be enforced
by the Chippewa County Sheriffs Office and other authorized officers.
Section 2. Intent and Authority.
(A)The intent of this ordinance is
to provide safe and healthful conditions for the enjoyment of aquatic
recreation consistent with public rights and interests, and the capability of
water resource as stated in the attached Environment Benefit Report, hereby
incorporated by reference.
(B)This ordinance is adopted
pursuant to §30.77(3)(a), Wis. Stats., which
Authorizes any Town, Village or
City, to, in the interests of public health, safety or welfare, adopt local
regulations not contrary or inconsistent with Chapter 30, Wis. Stats., relative
to the equipment, use or operation of boats or relative to any activity
regulated by §30.60 to 30.71, Wis. Stats.
Section 3. State Boating and Safety Laws Adopted.
State boating laws as found in
§30.50to 30.71, Wis. Stats., are adopted by
reference.
Section 4.
Definitions.
(A) "Slow-No-Wake” means that speed at which a boat
moves as slowly as possible while still maintaining steerage control.
(B) "Person" includes an individual,
partnership, corporation, the state and its
Agencies and subdivisions, and any other legal
entity.
(C) "Operate" means to navigate or otherwise
use a watercraft.
(D) "Watercraft" means any contrivance used
or designed for navigation on
water.
Section 5.
Restrictions.
(A) No person shall operate any watercraft which is
powered by an internal
Combustion engine upon the water of
(B) No person shall operate any watercraft at a speed
greater than slow-no-wake
upon the water of
(C) Exceptions. Authorized resources management
personnel, emergency
Personnel, and enforcement personnel, when acting in
the performance of their
duties, shall be exempt from the provisions of this
ordinance.
Section 6.
Posting Requirements.
The Town of
Public access points within the jurisdiction of the
Town pursuant to the
Requirements of NR 5.15,
Section 7.
Penalties.
Any person, partnership,
corporation, or other legal entity that fails to comply with the provisions of
this ordinance shall, upon conviction, be penalized by the Town of
Section 8. Severability.
The provisions of this ordinance shall be deemed
severable and it is expressly
declared that the Town of
provisions irrespective of whether or not one or more
provisions may be declared
invalid. lf any provision of the ordinance or the
application to any person or
circumstances is held invalid, the remainder of the
ordinance and the application
of such provisions to other persons or circumstance
shall not be affected.
Section lX.
Effective Date.
This section will become effective upon passage on
the day after publication.
